A delayed residence case may justify a procedural response, but there is no reliable “send this template and receive your card” formula. The applicable time limits, scope of a suspension, history of the case and available remedy all need to be examined.
What is a ponaglenie?
The Code of Administrative Procedure provides a formal mechanism concerning inactivity or excessive length of proceedings. It is different from an ordinary request for a status update. A court complaint is another procedural step, with its own requirements and possible outcomes.
Do not assume that sending an email containing the word ponaglenie completes the correct procedure or makes a court complaint immediately admissible.
Why the 2026 position is complicated
The Commissioner for Human Rights’ August 2026 report describes the extension of the suspension in covered residence matters to 4 March 2027. It also discusses court decisions and the ministry’s acknowledgement that courts may decline to apply the provision in particular cases, while the higher administrative authority remains bound by it.
That is why neither “all remedies are unavailable” nor “every case must finish in 60 days” is an adequate summary. The report explains a legal dispute; it does not guarantee the outcome of an individual complaint.
Build a case chronology first
Gather the application and filing evidence, dates of requests, your responses, appointments, notices of delay and any earlier remedies. Include periods when the office was waiting for something from you. A useful chronology distinguishes a silent period from a period with unresolved evidence requests.
| Question | Why the answer matters |
|---|---|
| Which procedure and authority? | Determines the legal framework and competent bodies |
| Which dates and procedural stage? | Identifies the period being challenged |
| Are documents still outstanding? | Affects the factual assessment of delay |
| What has already been filed? | Avoids confusing status enquiries with formal remedies |
| What result is sought? | Distinguishes obtaining action from other possible requests |
Ask for an assessment of the actual remedy
Before paying for a filing, ask what legal route is proposed, which suspension or transitional rules apply, what procedural steps are needed and what costs could arise. A firm’s fee is separate from possible court charges and the uncertain outcome of any costs award.
Do not assume that a complaint guarantees a positive residence decision. A remedy concerning delay is not the same as proving that the substantive conditions for the permit are met.
What you can do now
Organise the chronology, verify delivery arrangements and resolve any outstanding request. Then ask about review of the delayed case. STAYLEGAL agrees the scope after examining the record. There is no guaranteed acceleration date attached to a template or service purchase.
