“Family reunification” is often used broadly in conversation, but residence procedures depend on the precise family relationship and the status of the person in Poland. Joining a Polish spouse, joining a non-EU permit holder and accompanying an EU citizen should not be treated as one identical application.
Map the family situation first
Write down who is applying, the relationship, each person’s nationality, current residence basis and current location. For children, include age and parental responsibility. For a person already in Poland, record the current lawful-stay deadline.
The voivodeship family guidance and the Foreigners Act distinguish relevant grounds and sponsor statuses. Holding any temporary residence card does not automatically qualify a sponsor for every family route.
Documents follow the chosen basis
| Topic | Evidence to organise |
|---|---|
| Relationship | Relevant civil-status documents and other evidence required for the ground |
| Sponsor | Identity, nationality and the actual residence decision where relevant |
| Applicant | Passport, current status and application information |
| Living arrangements | Accommodation, resources and insurance where required by the route |
| Children | Documents establishing the relevant parental relationship and authority |
This is a preparation map, not a statement that every row is a legal requirement in every family case. The correct route determines which conditions apply.
Location changes the filing question
A family member outside Poland can involve a different process from someone applying while already here. The current MOS notice expressly lists certain family applications concerning people abroad among the exceptions to the general electronic filing route. Do not simply create the same online application for every family member without checking who files and how.
Check documents from abroad early
Civil-status documents can take time to obtain. Find out which originals, translations and authentication arrangements are needed for the issuing country and document type. Do not assume that apostille is required for every foreign document, or that a translation alone settles authenticity.
Resolve differences in names or dates with supporting evidence. Avoid “fixing” documents yourself to make them match.
Work and travel rights are separate questions
The rights associated with a family residence permission depend on its actual legal basis. A pending family application should not be treated as automatic work authorisation or a re-entry document.
For evidence concerning a spouse or partner, read marriage and unmarried relationships. To discuss a family case, contact STAYLEGAL with the relationship, statuses and locations. We identify the route before agreeing the scope.
